Wisconsin's Lead-Safe Renovation Rule Is Now In Effect

A Quick Overview Of The Rule

Both the federal and the state rules went into effect April 22, 2010. This new Wisconsin rule enforces a federal rule established by the Environmental Protection Agency in 2008 that was enacted to protect young children from being exposed to lead-based paint hazards that can be created during renovation activities.

The Lead-Safe Renovation Rule applies to pre-1978 residential property and child occupied facilities, such as day care centers and kindergartens and when more than 6 sq. ft on the interior or 20 sq. ft on the exterior are disturbed. These properties may contain lead-based paint on the walls, windows, doors, floors, etc. Lead hazards are created when old paint is disturbed during renovation, repair and painting activities.

This rule protects occupants, especially children, from being exposed to lead-based paint hazards during and after renovation, repair and painting activities that disturb painted surfaces. Children exposed to lead dust and debris run the risk of lead poisoning that causes permanent injury and affects the child's mental and physical health, well-being and success throughout the life span.

Every project requires at least one person that has completed a Lead-Safe Renovator course. This person can train the rest of the crew/uncertified workers. The Certified Renovator needs to be onsite when signs are posted, when containment is being set up, during clearance and for the cleaning verification at the end.
